Dominion Voting Systems and Fox News both face legal risks if their defamation battle goes to trial on Tuesday, but any last-minute settlement discussions would need to overcome two years of intense legal hostilities, Erin Mulvaney, Joe Flint, and Isabella Simonetti of The Wall Street Journal reports. On Sunday, the Journal reported Fox was making a push to settle the case and also said Dominion was scaling back its claims for $1.6B in damages, which Dominion has since denied. Fox has made previous attempts to reach an agreement with Dominion, but the two companies did not get close to a deal, people familiar with the matter told the Journal. While Dominion has evidence to demonstrate Fox knowingly broadcast false material, it may have difficulty establishing to the jury that is suffered significant financial harm due to the broadcasts.
