Trump’s team has argued to the appeals court that the CIT’s decision to pause the tariffs was “illegal” and that it could cause “irreparable economic and national security harms.”

The Trump administration also said that the CIT overstepped its reach by making a decision on foreign trade matters, stating that “The injunction unilaterally diminishes America’s bargaining position during sensitive trade negotiations, encouraging other countries to hold our nation hostage.”

Now, it’s up to the appeals court to decide on reinstating the tariffs or putting them back on hold. In the meantime, the U.S. continues to negotiate trade deals with other countries.
