Grounds for data collection

Processing of your Personal Information (meaning any information which may potentially allow your identification with reasonable means) is necessary for the performance of our contractual obligations towards you and providing you with our services and the operation of our website (hereinafter the “Services” and ” Website“), to protect our legitimate interests and for compliance with legal and regulatory obligations to which we are subject.

How do we receive data about you?

We receive and collect your Personal Information from various sources:

  1. Registration data – When you voluntarily provide us your personal details in order to create an account on the Website or register to our Services (for example, your name and email address);
  2. When you communicate with us – For example when you send us an email, we collect the Personal Information you provided us with and retain those communications in order to process your inquiries, respond to your requests and improve our Website and Services.
  3. Technical data – When operating our Services, we use various technological tracking tools to collect data regarding your use of the Services and Website. What type of data we collect?

Personal Information

In the course of using the Service, we may ask you to provide us with certain Personal Information to provide and improve the Service, to contact or identify you, to enable you to access certain parts of the Website, and as otherwise indicated in this Policy. We collect the following Personal Information about you:

Registration data your name, address, your email address, your age range and payment details.

When using our Services our webserver will collectyour IP address and UID.

Information from third parties in order to provide our Service, we may receive Personal Information from our business partners. This may include Personal Information such as your contact details (name, phone, email) as well as details pertaining to your company, your job, your activities and publications.

Non- Personal Information

We also collect data about the use of our Service and the characteristics and activities of users, in order to operate it and improve it. We may collect the following non- Personal Information:

Technical data this category includes data such as website visits, the browser you are using and its display settings, your operating system, device type, session start/stop time, time zone, network connection type (e.g., Wi-Fi, cellular), cookie data and your general location (city and country).

Data from third parties this category includes data we receive from our business partners. This may include pseudonymous advertiser identifiers that some Advertisers or other third party ad platforms choose to share with us. This data is also used to enhance data points about a particular unique browser or device.

If we combine Personal Information with non- Personal Information, the combined data will be treated as Personal Information. Further Personal Information will only be stored and processed if you voluntarily provide it to us, e.g. through a contact form.

Tracking Technologies

When you visit or access our Services we use (and authorize 3rd parties to use) pixels, cookies, events and other technologies. Those allow us to automatically collect data about you, your device and your online behavior, in order to enhance your navigation in our Services, improve our Websites performance, perform analytics and customize your experience on it. In addition, we may merge data we have with data collected through these tracking technologies with data we may obtain from other sources and, as a result, such data may become Personal Information.

We also use a tool called Google Analytics to collect data about your use of the Services. Google Analytics collects data such as how often Users access the Services, what pages they visit when they do so, etc. We use the data we get from Google Analytics only to improve our Services. Google Analytics collects the IP address assigned to you on the date you visit, rather than your name or other identifying data. We do not combine the data collected through the use of Google Analytics with personally identifiable data. Googles ability to use and share data collected by Google Analytics about your visits to our Services is restricted by the Google Analytics Terms of Use and the Google Privacy Policy.

How do we use the data we collect?

Provision of service  for the provision and improvement of our Services, including for support and to respond to your queries.

For the avoidance of doubt, any information shared with third parties will be completely anonymized and non-identifiable.

With whom do we share your Personal Information

Internal concerned parties – we share your data with companies in our group, as well as our employees, in order to provide you with our services.

Business partners – we share your data with business partners, such as storage and analytics providers who help us provide you with our service. These third parties may have access to your Personal Information so that they may perform these tasks on our behalf, but they are obligated to comply with this Privacy Policy and may not use your Personal Information for any other purpose.

Compliance with laws and law enforcement entities – we cooperate with government and law enforcement officials and private parties to enforce and comply with the law. Merger and acquisitions we may share your data if we enter into a business transaction such as a merger, acquisition, reorganization, bankruptcy, or sale of some or all of our assets. Any party that acquires

our assets as part of such a transaction may continue to use your data in accordance with the terms of this Privacy Policy.

EEA Users

We are providing information relating to rights of residents of the European Economic Area (“EEA”) if you use our Website and/or Service in the EEA. A “resident” of the EEA is an individual who is physically present in the EEA. This section does not apply to EEA citizens who are resident outside of the EEA (for example, a French citizen who is resident in the United States). From May 25, 2018, all processing of Personal Information of EEA Residents is subject to the General Data Protection Regulation (2016/679) of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of Personal Information and on the free movement of such data (“GDPR”).

Under the GDPR, we are both a controller and a processor of the Personal Information of EEA Residents. Our purpose for collecting and processing Personal Information from EEA Residents is to allow users to subscribe to and log in to our Website and Services and to provide our Services to our customers. Our legal basis for collecting Personal Information will be one of the following:

a. to fulfil our contractual obligations to you, for example to provide the Services or to ensure that invoices are paid correctly;

e. We may anonymize your Personal Information and use it for other purposes. For example, we may prepare aggregated reports about how users interact with the Services for research.

Under GDPR, your rights in relation to privacy and data protection are as follows:

  • Right of Access and Rectification . You have the right to know what Personal Information we collect about you and to ensure that such data is accurate and relevant for the purposes for which we collected it. We allow our users the option to access and obtain a copy of their Personal Information and to rectify such Personal Information if it is not accurate, complete, or updated. However, we may first ask you to provide us certain credentials to permit us to identify your Personal Information.
  • Right to Delete Personal Information or Restrict Processing . You have the right to delete your Personal Information or restrict its processing. We may postpone or deny your request if your Personal Information is in current use for the purposes for which it was collected or for other legitimate purposes such as compliance with legal obligations.
  • Right to Withdraw Consent . You have the right to withdraw your consent to the processing of your Personal Information. Exercising this right will not affect the lawfulness of processing your Personal Information based on your consent before its withdrawal.
  • Right of Data Portability . Where technically feasible, you have the right to ask to transfer your Personal Information in accordance with your right to data portability.
  • Right to Lodge Complaint . You also have the right to lodge a complaint with a data protection supervisory authority regarding the processing of your Personal Information.
  • International Data Transfers . If you are located in the EU, you have a right to request further information regarding the data transfer mechanisms used by us with respect to data transfers to third countries. How we protect your data

We have implemented administrative, technical, and physical safeguards to help prevent unauthorized access, use, or disclosure of your Personal Information. Your data is stored on secure servers and isn’t publicly available. We limit access of your data only to those employees or partners on a need to know basis, in order to enable the carrying out of the agreement between us.

While we seek to protect your data to ensure that it is kept confidential, we cannot absolutely guarantee its security. You need to help us prevent unauthorized access to your account by protecting your password appropriately and limiting access to your account. You will be solely responsible for keeping your password confidential and for all use of your password and your account, including any unauthorized use. Retention

Your California Privacy Rights

This following section of our Privacy Policy is for individuals who live in California (“California consumers“).

* Civil Code Section 1798.83 California consumers may make requests under California Civil Code Section 1798.83 to a business to provide detailed information regarding how that business has shared that customer’s Personal Information with third parties for direct marking purposes. This does not apply to us because we do not share your information with third parties for such purposes.

* Rights under the California Consumer Privacy Act (“CCPA”) came into effect on January 1, 2020, (California Civil Code Section 1798.100 et seq.). The CCPA provides California consumers who are resident in the state (regardless of citizenship) with additional rights regarding Personal Information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly with them. Under the CCPA, qualifying California consumers may have the following rights:

Right to Know and Right to Delete. If you are a California consumer, you will have the right to request that we disclose what Personal Information we collect and process about you. You also have the right to submit requests to delete certain Personal Information.

When we receive a request to know or delete from a California consumer, we will confirm receipt of the request within 10 days and provide you with information about how we will process the request, including process for making sure that you are the individual who is making the request. We will respond to such requests within 45 days.

Right for Disclosure of Information. If you are a California consumer, you may also submit requests that we disclose specific types or categories of Personal Information that we collect about you.

Under certain circumstances, we are not required to provide you with this information, including where the disclosure of the information would create a substantial, articulable and unreasonable risk to the security of that Personal Information, customers’ account with us, or the security of our systems or networks. If you are a California consumer, we will also not disclose your social security number, driver’s license numbers or other government-issued identification numbers, financial account numbers, any health insurance or medical identification numbers, or account passwords and security questions and answers, if any of such Personal Information was collected by us.

Verifying Requests. If we receive any request from you we will use a two-step process for online requests where the California consumer must first, clearly submit the request and then second, separately confirm the request. We will use other appropriate measures to verify requests received by mail or telephone.

If you are a California consumer submitting a request, you must provide sufficient information to identify yourself, such as name, e-mail address, home or work address, or other such information that is on record with us so that we can match such information to the Personal Information that we maintain. Do not provide social security numbers, driver’s license numbers, account numbers, credit or debit card numbers, medical information or health information with requests. If your request is unclear or submitted through means other than described above, we will give you specific directions on how to submit the request or remedy any deficiencies. If we cannot verify your identity, we may deny the request.

California Do Not Track Disclosures. Although some browsers currently offer a “do not track (‘DNT’) option,” no common industry standard for DNT exists. We therefore do not currently commit to responding to browsers’ DNT signals.

Third Party Services

TipRanks may use Plaid Inc. (“Plaid”) to gather your data from financial institutions for the purpose of synchronizing your Smart Por olio holdings. Any such synchronizing will be performed only with your explicit request by selecting the sync op on in the Smart Por olio tool. By using the Service, you grant TipRanks and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information on from your relevant financial institution. You agree to your personal and financial information on being transferred, stored, and processed by Plaid in accordance with the Plaid end user privacy policy


Consent to Processing

By providing any Personal Information to us pursuant to this Privacy Policy, all users or the Website and/or Services, including, without limitation, users in the United States, Israel and member states of the European Union, fully understand and unambiguously consent to this Privacy Policy and to the collection, usage, and/or processing of such Personal Information abroad.
